Statutory Obligations

- The Workmen Compensation Fund - Which states an employer must register with the Compensation Fund and pay annual assessment fees.
The Compensation Fund is a trust fund that is controlled by the Compensation Commissioner and the employer contributes to the Compensation Fund. - The Skills Development Levy (SDL) - This goes toward helping workers develop their skills. The SDL contributions total 1% of total salaries, but employees do not have to contribute any of their own salaries to the fund.
All allowances and benefits are taxable and make no difference to offer employees a consolidated salary or basic salary with multiple allowances.

When working in South Africa there are many kinds of leave you are legally required to be given, such as:
- Annual Leave - A minimum of 21 working days per year
- Maternity Leave - Which spans four months for female employees
- Paternity - Which spans ten days for male employees
- Sick Leave - Employees should receive a one-day sick leave for every 26 days worked during the first four months of their employment. During each 36-month cycle, an employee is entitled to paid sick leave equal to the number of days worked in six weeks.
- Family Responsibility Leave - Where three days are given during each annual leave cycle. This applies to employees who have worked for more than four months and those who have worked for at least four days a week for the same employer. This is normally taken in the event of a child’s sickness or in the event of the death of an immediate family member.
There is no legal provision on other leaves like compassionate or emergency leave and that is left to the individual employer’s HR Policy.
Working Hours In South Africa
You should also bear in mind that the official working hours in South Africa are 45 hours a week which are distributed over a five-day working week with a one-hour lunch break per day.
Additionally, overtime in South Africa includes hours worked above the regular 45 hours per week, which are to be paid 1.5 times the employee’s wage for a normal working day and 2 times for hours worked on a rest day and public holiday.
